Interest in Antitrust Law in Israel is on the Rise

This is a fascinating time for those involved in antitrust law and for those interested in the field in Israel.  Over the years, a normative and interpretative foundation has been established for Israeli antitrust law, through the development of the caselaw that the judiciary branch has produced, and through the decisions of the General Director of the IAA.   We are now experiencing a gradual process of the absorption of the law in Israel, which is accompanied by an increased awareness of the existence and purpose of the antitrust laws among the general public, the members of the]business community and legal counsel.  A number of significant reforms have taken place at the IAA’s initiative in recent years, including a change in the manner of reporting of merger transactions, the establishment of a procedure for the issuance of preliminary opinions, the expansion of the class action section of the Law, the launching of immunity program and an internal compliance initiative, and the cancellation of the general exemption for air transportation and its replacement with a set of group exemption rules.  Two memoranda have also been prepared, the purpose of which was the modernization of the Restrictive Trade Practices Law through the announcement of, inter alia, a significant reform regarding restrictive arrangements centered on a new definition of the term “restrictive arrangement” in the Law, and a similar reform which is expected to improve the handling of oligopolies.

In addition, the IAA's has abundance of international activity.  During the past year, the OECD’s peer review examination of Israel’s competition law and policy was successfully concluded.  In addition, the IAA has for several years served as an observer at the OECD’s Global Forum on Competition, as a member of the steering committee of the International Competition Network (the ICN) and as chairman of that organization’s Committee on the merger review techniques.  The IAA’s international involvement allows it to contribute to the global antitrust community and to draw on the experience of other competition agencies and of international forums with regard to questions of law and practice.

The IAA’s English website has been designed as a useful and user-friendly tool.  It is intended to serve you: the general public; antitrust practitioners in Israel and abroad; students and all those interested in and wishing to increase their knowledge of what is being done in this field in Israel.

Through the site, the IAA is proud to present you with useful and analytical information regarding Israel’s antitrust laws, translated into English.  The main attraction of the site is a database, which brings together, inter alia, all the Israeli antitrust laws, including the group exemptions; many of the General Director’s determinations regarding monopolies, restrictive arrangements and mergers; and court rulings, including rulings from the Supreme Court, from the Antitrust Tribunal (in civil proceedings and appeals) and from the general courts (in criminal cases, private enforcement proceedings and class actions).  The database also includes directives and position papers which the IAA has produced, useful forms and a newsroom which provides constant updates regarding the latest antitrust developments.

I am hopeful that this website will give the general public greater access to the various publications in the field and will further contribute to the creation of a lively antitrust community.  Such a development is, in turn, a basic condition for the absorption among businesses, professionals and the general public of the legal principles involved in this field.
